Refund and Cancellation Policy

This Refund and Cancellation Policy applies to services provided by Ecomberry LLC, 704 Wallace St, Suite 581, Clovis, NM 88101, USA (“Ecomberry,” “we,” “us”). It forms part of our Terms of Service. No payment is processed through our website; all services are contracted through a written proposal or agreement and invoiced directly. In case of conflict between this Policy and a signed service agreement or accepted proposal, the signed agreement or proposal prevails.
1. Cancellation Before Work Begins
You may cancel an accepted proposal at no charge at any time before we begin performance of the services, by written notice to contact@ecomberry.net. Any amount already paid for services not yet started will be refunded in full within [14] days, using the same payment method where possible.
2. Cancellation After Work Has Begun
If you cancel after we have started performance:
- You remain responsible for the portion of the services already performed, calculated pro rata based on work completed and documented up to the date we receive your cancellation notice, plus any non-recoverable third-party costs already incurred on your behalf (e.g., software licenses, ad spend, subcontracted work).
- Any balance of prepaid fees exceeding that amount will be refunded within [14] days.
- Deliverables completed and paid for up to the cancellation date will be transferred to you in accordance with the Terms of Service.
3. Cancellation by Ecomberry
We may cancel or suspend an engagement if (a) invoices remain unpaid after reminder, (b) you materially breach the Terms of Service or the applicable agreement, or (c) circumstances beyond our reasonable control prevent performance. In case of cancellation by us for reasons not attributable to you, we will refund any prepaid fees corresponding to services not performed.
4. Retainers and Recurring Services
For monthly or recurring engagements:
- Either party may terminate with [30] days' written notice, unless the proposal states otherwise.
- Fees for the current period remain due; no partial-month refunds are made once the period's work has commenced, except as required by applicable law.
5. Refund Requests and Quality Concerns
If you believe a deliverable does not conform to the agreed scope, notify us in writing within [14] days of delivery, describing the non-conformity. We will first seek to remedy the issue by correcting or re-performing the relevant work within a reasonable time. If we are unable to remedy a substantiated non-conformity, we will offer a partial or full refund of the fees corresponding to the non-conforming portion of the services.
Refunds are not available for dissatisfaction with outcomes that were not contractually guaranteed (e.g., specific levels of sales, traffic, or revenue), for changes of mind after delivery, or for delays caused by your failure to provide required materials, access, or feedback.
6. EU/UK Consumers — Statutory Right of Withdrawal
If you are a consumer residing in the European Union or the United Kingdom and you enter into a contract with us at a distance, you have a statutory right to withdraw from the contract within 14 days of its conclusion, without giving any reason.
- To exercise this right, send an unambiguous statement to contact@ecomberry.net before the deadline, including your name, the service concerned, and the order date.
- If you expressly request that we begin performing the services during the withdrawal period, and you subsequently withdraw, you will owe us an amount proportionate to the services provided until you informed us of your withdrawal.
- The right of withdrawal is lost once the services have been fully performed, if performance began with your prior express consent and your acknowledgment that you would lose the right of withdrawal upon full performance.
- Refunds due under this Section are made within 14 days of receiving your withdrawal notice, using the same means of payment you used.
7. Mandatory Local Rights
Nothing in this Policy limits any non-waivable rights you may have under the consumer protection laws of your country or state of residence. Where such laws grant you greater rights than this Policy, those laws prevail.
8. How Refunds Are Processed
Approved refunds are issued using the original payment method whenever possible, within [14] days of approval. Bank charges or exchange-rate differences applied by your bank are outside our control.
